This Acceptable Use Policy (the Policy) applies to every person who accesses or uses the Services or the Website, including the Customer, its Authorised Users and the end users of every product a Customer builds with the Services. It forms part of, and is incorporated into, the Terms of Use between Bynn Intelligence, Inc. (Bynn) and the Customer. Capitalised terms not defined in this Policy have the meanings given in the Terms of Use.
Where a Product publishes its own acceptable use rules in its Product Terms, those rules apply to that Product in addition to this Policy, and the stricter rule prevails.
Transition. For a Customer that accepts the Terms of Use on or after 17 October 2026, this Policy applies from that acceptance. For a Customer that accepted the Bynn Intelligence Inc. Terms & Conditions of 21 May 2025 (the Prior Terms), this Policy takes effect on 17 November 2026, at least thirty (30) days after Bynn's notice of it, and the Prior Terms govern until then. Any right the Prior Terms give that Customer to object to a change and to terminate with a refund continues for the period the Prior Terms give.
Section 1. Illegal and harmful activity
#No one shall use the Services or the Website, or permit any person to use them, to:
violate Applicable Law, or infringe, misappropriate or violate the intellectual property, privacy, publicity or other rights of any person;
defraud, deceive or mislead any person, including by phishing, scams, impersonation, forged or manipulated documents, or other fraudulent schemes;
create or distribute synthetic or manipulated media of a real person intended to deceive, or to harass or sexualise that person without their consent;
create, distribute or facilitate malware, spam or unsolicited communications;
threaten, harass or intimidate any person, or promote or incite violence, terrorism, violent extremism or hatred against any person or group; or
traffic in or exploit persons, or facilitate trade in illegal goods, services or controlled substances.
Section 2. Weapons and military use
#Weapons. The Customer shall not use the Services to design, develop, produce, acquire, stockpile or use weapons intended to injure or kill, including biological, chemical, nuclear and radiological weapons.
Important: Military use only under a signed agreement
Military use. The Customer shall not use the Services for military purposes, or in connection with the armed forces or intelligence services of any state, unless it has signed a written agreement with Bynn that expressly permits that use, and then only within its terms.
Important: Targeting people prohibited
Harm to people. The Customer shall not use the Services to choose, rank or target natural persons for physical or lethal harm, or to aim, arm, trigger, release or deliver any weapon or payload intended to injure or kill people or animals or to damage property.
Vehicles, unmanned aircraft and robots. The Customer may use the Services in connection with civilian vehicles, unmanned aircraft, vessels, robots, machines and simulators, such as for survey, inspection, mapping, delivery, agriculture, industrial monitoring and training, subject to Section 7.4 of the Terms of Use. The Customer shall not use the Services in connection with any such system to operate it in breach of aviation, unmanned aircraft, road traffic, maritime or other law, including airspace restrictions, or to evade lawful detection, identification or interception, or to track any natural person in breach of Section 4.
Section 3. Decisions about people
#Important: Qualified review required
Qualified review of consequential decisions. The Customer may use the Services to support decisions that produce legal or similarly significant effects on natural persons, including decisions about hiring, credit, housing, insurance, education, benefits, law enforcement and healthcare, only where (a) a qualified person reviews each such decision before it takes effect, with the authority and the information to change it; and (b) the use complies with Applicable Law, including anti-discrimination, consumer protection, data protection and artificial intelligence law. Section 3.2 applies instead to age assurance and identity verification.
Age assurance and identity verification. Where the Customer uses the Services to check a person's age or identity, for example to decide whether the person may open an account or reach age-restricted content, a decision may be made automatically, without review before it takes effect, provided that the Customer (a) tells the person that the check is automated; (b) gives a person who is refused a clear and prompt way to obtain review by a qualified person, to contest the result and to use another method of checking where the law or the context calls for one; and (c) does not use the result for any decision other than the access it was made for. Where Applicable Law requires review before the decision takes effect, Section 3.1 applies.
Protected characteristics. The Customer shall not use the Services to treat a person less favourably because of their race, colour, ethnicity, national origin or nationality, religion or belief, sex, gender identity, sexual orientation, disability, pregnancy, caste, immigration status, political opinion or age, except where Applicable Law allows that attribute to be considered and the decision genuinely depends on it, such as age for age assurance where the law requires it.
Social scoring. The Customer shall not use the Services to evaluate or classify natural persons on the basis of their social behaviour or personal characteristics where the resulting score leads to their detrimental treatment in contexts unrelated to those in which the data was generated, or to treatment that is unjustified or disproportionate.
Sensitive traits. The Customer shall not use the Services to infer a person's race or ethnic origin, religion, sexual orientation, political opinion, health or a similar sensitive trait, unless the person has given explicit consent or Applicable Law permits it.
Section 4. Surveillance and biometric identification
#Surveillance. The Customer shall not use the Services for mass surveillance, or to track, monitor or profile individuals without a lawful basis. This includes (a) recognising the emotions of natural persons in the workplace or in education, except for medical or safety reasons where Applicable Law permits it; and (b) predicting whether a natural person will commit a criminal offence on the basis of profiling or an assessment of their personality traits alone.
Biometric identification. The Customer shall not use the Services to identify natural persons from their biometric data without the notice, consent and lawful basis that Applicable Law requires, to build facial recognition databases by untargeted scraping of images from the internet or from camera footage, or for real-time remote biometric identification in publicly accessible spaces except as Applicable Law expressly permits.
Section 5. Children and self-harm
#Children. No one shall use the Services to create, distribute or solicit sexual content involving minors; to groom, exploit, bully or harass minors; or to build products designed to make minors use them compulsively. Bynn reports apparent child sexual abuse material to the competent authorities as the law requires.
Self-harm. No one shall use the Services to help any person harm or kill themselves. Using the Services to detect a risk of self-harm and to connect people with help is encouraged; where a product serves people who may be at risk, it shall offer a clear way to reach human help.
Section 6. Protecting the Services and the Website
#No one shall, or shall permit any person to:
reverse engineer, decompile or disassemble a hosted Service, or attempt to extract its Models' weights, parameters, training data or design;
scrape or crawl the Services or the Website, or access them by automated means other than as the Documentation, an Order Form or the Website's robots.txt instructions permit;
access the Services in any unauthorised way, or access the data of any other customer;
circumvent, disable or interfere with any security, safety, rate or usage control, including by splitting, disguising or altering submissions to avoid a control;
disrupt, overload or impair the Services or the Website;
probe, scan or test the vulnerability of the Services or the Website without Bynn's prior written permission (security findings may be reported to security@bynn.com); or
use Outputs to develop, train or improve a model or service that competes with the Services.
Section 7. Customer products and end users
#The Customer is responsible for how its Authorised Users and the end users of its products use the Services. The Customer shall maintain reasonable measures, including terms of use and monitoring appropriate to its product, to prevent them from doing what this Policy forbids, and shall act promptly, including by suspending the person concerned, on becoming aware of a breach.
Section 8. Enforcement and reporting
#Investigation and action. Bynn may investigate any suspected breach of this Policy, including by reviewing usage data and, where necessary for the investigation, the relevant Customer Data. Bynn may require information from the Customer, and may suspend or end access as Section 11 of the Terms of Use provides, with notice where it can reasonably give it.
Reports to authorities. Bynn reports to the competent authorities where the law requires it, and may do so where it believes in good faith that a report is necessary to prevent imminent harm to any person.
How to report. Report misuse of the Services or the Website to abuse@bynn.com and security issues to security@bynn.com.
Section 9. Changes
#Bynn gives Customers at least thirty (30) days' notice of a material change to this Policy, except for a change needed urgently for safety or security, or required by Applicable Law, which applies as soon as Bynn gives notice of it.
